| Résumé: | لاشك أن قواعد العدالة والمبادئ العامة للقانون هما فكرتان لهما عناصر التشابه وعناصر التباين لا يمكن إدراكها بعيدا عن فلك الاجتهاد القضائي والقانون و هذه المسالة المحاطة بالالتباس في فهمها سواء من قبل القضاة أو رجال القانون وعليه سوف يسلط الضوء على مفهومهما ونعطي أمثلة عن تطبيقاتهما القضائية والقانونية وسوف يتم التركيز على قواعد العدالة باعتبار أن القانون المدني الجزائري ذكرها كمصدر يستلهم منه القاضي اجتهاده لإيجاد القاعدة القانونية المناسبة على النزاع المطروح ونتطرق إلى إي مدى تؤثر قواعد ومقتضيات العدالة على الاجتهاد القضائي و حركة وتطور القواعد والنصوص القانونية . |
| Description: | There is no doubt that the rules of justice and the general principles of law are two ideas that have elements of similarity and elements of variation that cannot be realized away from the orbit of jurisprudence and law and this issue is surrounded by confusion in its understanding, whether by judges or jurists, and therefore it will highlight their concept and give examples of their judicial and legal applications, and the focus will be on the rules of justice, as the Algerian Civil Code mentioned it as a source from which the judge inspires his jurisprudence to find the appropriate legal base on the dispute at hand and we address To what extent do the rules and requirements of justice affect jurisprudence and the movement and development of legal rules and texts |
