| Résumé: | تتناول هذه الورقة البحثية مسائل تتعلق بتصدي القاضي في حال ثبوت أي إخلال بالنظام العام الدولي في سياق حكم التحكيم التجاري الدولي، وذلك في غياب وجود معالم واضحة لهذا النظام والذي يتمتع القاضي بموجب قانون الإجراءات المدنية والإدارية بسلطة تقديرية واسعة، فهذا النظام مرتبط بالتزامات الدولية للجزائر، ومقترن بالاعتراف بالمبادئ العامة للقانون المطبقة في العديد من الدول في جوانبها الاجرائية والموضوعية، اذ اشار قانون الإجراءات المدنية والإدارية إلى بعض من جوانبها مقتفيا اثر المشرع الفرنسي لكنه اعتمد المفهوم الواسع متجاوزا بذلك الحدود التي رسمتها اتفاقية نيويورك 1958 بشان الاعتراف بالأحكام التحكيمية الاجنبية . |
