| Résumé: | يعتبر مفهوم الخدمة من المفاهيم الإقتصادية التي أدمجت في المجال القانوني، لا سيما في شقها المتعلق بقانون الأعمال بحيث يعتبر قانون الإستهلاك على رأس هذه القوانين، الذي أشار إلى هذا المصطلح دون إيلاء أهمية خاصة لمفهومه ، إذ جمع كلا من السلعة والخدمة تحت مصطلح واحد هو المنتوج وأسقطت عليه نفس القواعد الحمائية دون الأخذ في الحسبان الإشكاليات التي قد تثور عن ذلك، وإنه بلا شك السبب الذي يدفعنا للبحث في كيفية إندماج هذا المفهوم ذو الملامح الاقتصادية في قاموس قانون الأعمال، خاصة أنه يعتبر من الكلمات المفتاحية ومن ضمن أساسيات قانون حماية المستهلك، مع التطرق إلى بعض الإشكاليات التي يطرحها إستخدام هذا المصطلح إلى جانب مصطلح المنتجات. |
