dc.description	Freedom of the press is considered one of the most important public freedoms in democratic societies, as it has a profound impact on ensuring citizens' right to information. The profession of journalist is the material support of the freedom of opinion and expression, and it is characterized by characteristics unprecedented in other professions. Among these characteristics is the condition of conscience, which is a unique case in the employment relationship in the journalistic profession, as it allows the salaried journalist to terminate the employment relationship of his own volition while benefiting from material compensation. as if it were a dismissal. This is considered to be a departure from the general provisions established in labor relations. The purpose of the condition of conscience is to guarantee the independence and freedom of journalists in the exercise of their activity. The Algerian legislator followed this singular approach through law 07-90 and organic law 05-12	en_US
dc.description.abstract	تعتبر حرية الصحافة أحد أهم الحريات العامة في المجتمعات الديمقراطية، لما لها من تأثير بالغ على ضمان حق المواطن في الإعلام. ومهنة الصحافة باعتبارها السند المادي لحرية الرأي والتعبير، تتميز بميزات خاصة لا نظير لها في المهن الأخرى، ومن هذه الميزات " شرط الضمير" الذي يعد حالة فريدة من نوعها في علاقة العمل في المهنة الصحفية، إذ يسمح للصحفي الأجير من إنهاء علاقة العمل بإرادته المنفردة مع استفادته من التعويضات المادية كما لو كان تسريحا. ويعتبر هذا خروجًا عن الأحكام العامة المقررة في علاقات العمل. والهدف من " شرط الضمير" هو ضمان استقلالية وحرية الصحفي أثناء ممارسته لنشاطه، وقد ساير المشرع الجزائري هذا النهج الفريد من خلال القانون 90-07 والقانون العضوي 12-05.	en_US
