| Abstract: | لقد كان موقف المشرع الجزائري بشأن الحماية الجزائية لعمل الأطفال أكثر صرامة وحسم تجاه المستخدمين، وإن اختلفا مع نظرائه من المشرعين في الدول الأخرى فيما يتعلق بالسن القانونية لدخول الطفل عالم الشغل والعمل، إلا أنه يجب على المجتمع الدولي البحث عن تعريف دقيق ومحدد لمفهوم الطفل العامل، وذلك لوضع حد فاصل بينه وبين الفئات العمالية الأخرى، مع إدراج قوانين داخلية وبصفة إلزامية تحدد سن تشغيل الطفل، والسبب في ذلك ما ورد على لسان المشرع الجزائري حينما نص في المادة 143 والتي جاء فيها عبارة "الشبان والنسوة"، وذلك من أجل تحديد أحكام وقواعد تحمي الأطفال حين تشغيلهم في سن مبكرة. لأنه من المفروض العمل على تشجيعهم وتحسين ظروفهم داخل المدارس وحثهم على البقاء في المقاعد الدراسية لأن عالم الشغل لا يرحمهم |
| Description: | The labor relationship is the legal association that binds the worker to the employee arising from a voluntary agreement namely the employment contract. This idea is of a human nature, which tends to protect the interest of the worker as the economically weaker part of the working relationship. A compliance contract is the contract in which one of the contractors does not have full freedom as the other party enjoys by virtue of its legal status by the terms of the contract, and the first party remains free to accept or reject the whole contract. Through this study ; we will explain the concept of both compliance and individual and collective employment contracts , the place of compliance in works relations and the impact of this on the contractual relationship and ways to confront it in a legislative manner |
