| Résumé: | ازدهرت المعاملات الالكترونية في الآونة الأخيرة أين أصبحت تعتبر البديل للمعاملات التقليدية نظرا للتطور الكبير لاتصالات التكنولوجيا و ما لها من تأثير على المعاملات العقدية. تأسيسا عل ذلك أضحى العقد الالكتروني أداة أساسية مزاولة التجارة الالكترونية المكرسة بموجب القانون 18-05 ،مما يستدعي بنا الأمر إلى البحث في موضوع العقد الالكتروني من حيث تحديد مفهومه و لطبيعة القانونية له بما أنها تتأرجح بين الصفة التفاوضية و صفة الإذعان. لعل إضفاء هذه الصفات على العقد الالكتروني يستدعي إلى تحديد الوسائط الالكترونية التي يتم من خلالها إبرامه و تنفيذه |
| Description: | Electronic transactions have flourished in recent times, where they have become considered an alternative to traditional transactions due to the great development of technology communications and their impact on contractual transactions. Based on this, the electronic contract has become an essential tool for practicing electronic commerce devoted by Law 18-05, which calls for us to research the subject of the electronic contract in terms of defining its concept and legal nature since it oscillates between the negotiating capacity and the quality of acquiescence. Perhaps adding these characteristics to the electronic contract calls for determining the electronic means through which it is concluded and executed. |
