| Abstract: | لا شك أن عدم تنظيم عقد الوعد بالتفضيل في القانون المدني الجزائري باعتباره نظام قانوني مستقل عن نظام الوعد بالتعاقد، يعتبر مصدرا للآأمن القانوني، لذلك يقع على عاتق المشرع وضع هذه العملية التعاقدية ضمن اطار تشريعي يستجيب بشكل فعال لتوقعات الأطراف، لاسيما توقعات المستفيد من الوعد، فضلا عن توقعات الغير المهتم بالعقد الموعود به. |
| Description: | There is no doubt that the absence of regulation for the promise of preference contract in the Algerian Civil Code, as it is a legal system independent of the contracting promise system, is a source of legal insecurity. Therefore, it is the responsibility of the legislator to place this contractual process within a legislative framework that responds effectively to the expectations of the parties, especially the expectations of the beneficiary of the promise. As well as the expectations of those who are interested in the promised contract. ا |
