| Abstract: | نستعرض في هذا المقال مسألة الطبيعة القانونية لأحد المناطق البحرية الموقوفة على الإنسانية و الأكثر جدلا في وقتنا الحالي، و هي المنطقة الدولية غير الخاضعة للسيادة الوطنية أو ما تسمى" المنطقة"حسب اتفاقية الأمم المتحدة لقانون البحار لسنة 1982.فقد أثارت هذه المسألة نقاشا فقهيا و قانونيا واسعا و اختلاف في المواقف بين دول العالم بسبب الأهمية الأمنية و الاقتصادية و الإستراتيجية للمنطقة و مواردها الطبيعية. من الفقهاء من رأى أن المنطقة هي مال مباح أي مال لا مالك له Res Nullius،و البعض الآخر اعتبرها مال مملوك ملكية مشتركة Res Communis و جانب آخر من الفقه رأى أنها تراث مشترك للإنسانية |
| Description: | Common Heritage of Mankind. Abstract: In this article, we review the issue of the legal nature of one of the marine areas endowed on humanity and the most controversial at the present time, which is the international zone that is not subject to national sovereignty or what is called the ”ZONE” according to the United Nations Convention on the Law of the sea of 1982. This issue has raised a jurisprudential and legal debate and a wide difference in attitudes among the countries of the world due to its security, economic and strategic importance and its natural resources. Among the jurists who saw the area as permissible property that has no owner, ” Res Nullius.” Others considered it common property ” Res Communis”, and another of jurisprudence saw it as the Common Heritage of Mankind. |
