| Abstract: | يعد مبدأ الأمن القضائي أحد المبادئ الهامة التي ترتكز عليها دولة القانون، إذ أن هذا الأخير يعزر ثقة المتقاضين في الجهاز القضائي لما هو صادر عنه من أحكام وقرارات وأوامر قضائية، حيث أن القضاء هو السلطة التي تعود لها صلاحية الفصل بين المتخاصمين وفض النزاعات بينهم، لأن الهدف من و راء ذلك هو حماية حقوق المتقاضين وتحقيق العدالة بينهم. ومن أجل إحقاق العدل والتطبيق الأمثل والأسمى لسلطان القانون ينبغي أن تكون هناك سلطة قضائية مستقلة تفصل في المسائل المعروضة عليها دون أي تحيز أو أي ضغط من أية جهة ولأي سبب كان حيث تضمن الشفافية والنزاهة والمصداقية في الأعمال القضائية وهذا ما يحقق في الأخير الإرساء الفعلي لدولة القانون حيث يكون القانون فوق الجميع دون استثناء. |
| Description: | The principle of judicial security, is one of the important principles on which the rule of law is based, because it enhances the confidence of litigants in the judiciary because of its rulings, dicisions and court orders, the judiciary is the authority that has the power to separate the adversaries and resolve disputes between them, because the aim is to protect the rights of litigants and to bring justice to them. In order to achieve justice and the best and highest application of the rule of law there should be an independent judiciary adjudicate the matters before it without any bias or pressure from any party and for whatever reason ensuring transparency, integrity and credibility in judicial proceeding this is what is achieved in the end the actual establishment of the state of law where the law is above all without exception |
