| Abstract: | يحتفظ المشرع الجزائي في القواعد العامة للركن المعنوي على مجموعة من الأصول والمبادئ، ولعل أهم هذه المبادئ مبدأ "لا جريمة بدون خطأ". والخطأ بالمعنى العام قد يكون خطأ عمديا أو غير عمدي مع استئثار القاعدة بالقصد الجنائي والاستثناء الخطأ أو الإهمال بوجود نص. إلا أنه بالعودة إلى النصوص المتعلقة بالجرائم الجمركية نجد أن التشريعات لم تتطرق إلى الركن المعنوي للجرائم الجمركية إلا حد أستخلص منه عدم اشتراطه بوصفها –الجرائم الجمركية- جرائم مادية كقاعدة عامة، وتارة أخرى نجد من خلال تلاوتنا لبعض النصوص القانونية أن المشرع يشترط توافر الركن المعنوي في الجرائم الجمركية كاستثناء على القاعدة العامة. ومنه تأتي هذه الدراسة للبحث في مدى وجود الركن المعنوي في الجرائم الجمركية من عدمه. |
| Description: | The penal legislator maintains in the general rules of the moral pillar a set of principles and principles, and perhaps the most important of these principles is the principle of “no crime without error.” And the error in the general sense may be a deliberate or unintentional error with the rule excluding criminal intent and the exception or error or negligence in the presence of a text. However, by returning to the texts related to customs crimes, we find that the legislation did not address the moral element of customs crimes except to the extent that it was not stipulated that they are - customs crimes - material crimes as a general rule. Customs offenses as an exception to the general rule. Hence, this study comes to examine the extent to which there is a moral element in customs crimes or not. |
