Abstract:	يترتب على عقد الزواج آثار تتعلق بالزوجين وبأقربائهما، مما يجعله يتسم بالخطورة، التي تولد عنها عدة إشكالات، حاولت التشريعات جعله بعيدا عن العلاقات الجنسية الأخرى، وذلك بتقنينه، وصار من اللازم إفراغه في قالب رسمي أمام جهة إدارية معينة، حددها المشرع الجزائري في ضابط الحالة المدنية. رغم ذلك لم يمنع من اللجوء إلى إبرام عقود زواج خارج الإطار الرسمي، ولا شك أن عدم التسجيل سينتج عنه إشكالات مستقبلا تعود على الجميع، وفي النهاية يجد الزوجان نفسيهما في المحاكم يصارعان من اجل تسجيل زواجهما، ما يستنزف وقتهما وأموالهما، لذا فإن المسؤولية يتحملها الجميع وأخص بالذكر المشرع إزاء النقائص والثغرات في هذا الباب
Description:	The marriage contract has effects, making it dangerous, which generates many problems. Legislation tried to make it separate from other sexual relations by legalizing it, and it became a duty to release it before the civil status officer. Despite this, it has not been prevented from resorting to concluding marriage contracts outside the official framework, and there is no doubt that failure to register will result in problems, and the spouses find themselves in the courts struggling to register their marriage, so the responsibility is borne by everyone, and I especially mention the legislator about the shortcomings and loopholes. ا
