| Abstract: | تعد تجارة المقايضة الحدودية آلية تشريعية لتنمية المناطق الحدودية وتلبية احتياجات سكانها خاصة الصحراوية منها بالنظر لموقعها الجغرافي. وبغرض تحقيق هذه الأهداف عمل المشرع على وضع ضوابط تشريعية لهذا النشاط التجاري العابر للحدود الذي يعتمد على التبادل التجاري مع المتعاملين الاقتصاديين لدول الجوار وذلك بفرض شروط وكيفيات وإجراءات ممارستها حماية للاقتصاد الوطني ومكافحة ظاهرة التهريب من جهة وفي ظل احترام قواعد حماية المستهلك والصحة النباتية والحيوانية من جهة أخرى. ولما كانت مخالفة القاعدة القانونية أمر وارد فقد جعل المشرع الأحكام المنظمة لنشاط المقايضة الحدودية مقترنة بجزاءات مختلفة إدارية وجزائية ومدنية في حالة مخالفتها |
| Description: | The border barter trade is concidered as a legislative mechanism to develop border regions and meeting the needs of their inhabitants, especially the desert ones, given their geographical location. In order to achieve these goals, the legislator has worked to set up legislative regulations for this cross-border commercial activity that depends on commercial exchange with economic dealers in neighboring countries, by imposing conditions, modalities and procedures for practicing protection of the national economy and combating the phenomenon of smuggling on the one hand, within the respect of the consumer protection rules and phytosanitary and animal health, on the other hand. Given that the violation of the legal rule is a possibility, the legislator has made provisions regulating the activity of border barter combined with various administrative, penal and civil penalties in case of violating them |
