Résumé:	فرض تعاظم دور الدولة في الوقت الحالي، و تدخلها المتزايد في تنظيم مختلف العلاقات الناشئة بين الأفراد، على المشرعين التدخل من أجل سن قواعد قانونية تقبل بطبيعتها الانطباق على العلاقات التي تتجاوز حدود الدولة الواحدة، خاصة أمام تنامي هذه العلاقات و عدم قدرة منهج التنازع التقليدي على الإيفاء بمتطلباتها و حل المنازعات الناجمة عنها، و هو الوضع الذي فرض الإستعانة بمنهج القواعد ذات التطبيق الضروري كحل يوازن بين طبيعة العلاقة و مصلحة الدولة
Description:	The growing role of the state at the present time, and its increasing interference in the regulation of various relationships emerging between individuals, forced legislators to intervene in order to enact legal rules that by their nature accept applicable to relationships that transcend the borders of one state, Especially in the face of the growth of these relations and the inability of the traditional method of conflict to fulfill its requirements and resolve the disputes arising from it, and this is the situation that imposed the use of the methodology of rules with the necessary application as a solution that balances the nature of the relationship and the interest of the state.
