| Abstract: | يهدف البحث إلى تحديد مفهوم التحكيم في منازعات عقود الشراكة بين القطاعين العام والخاص ذات الطابع الدولي، وبيان موقف المشرع من مسألة التحكيم في منازعات العقود المبرمة في إطار الشراكة بين القطاعين العام والخاص ذات الطابع الدولي، وعرض موقف الفقه والقضاء الإداريين من ذلك في بعض التشريعات المقارنة والتشريع الجزائري، وتحديد آثار التحكيم لمعرفة دور التحكيم في حل منازعات عقود الشراكة بين القطاعين العام والخاص ذات الطابع الدولي. وأفرزت الدراسة الأهمية البالغة والعملية للتحكيم في منازعات العقود الإدارية بصفة عامة، على أن تبقى فعاليته مرهونة بمدى التزام الأطراف بتنفيذ أحكام المحكمين وحل منازعات عقود الشراكة بين القطاعين العام والخاص ذات الطابع الدولي عن طريق التحكيم دون اللجوء إلى القضاء. الكلمات المفتاحية: شركاء، عقود شراكة دولية، خصومة تحكيمية، هيئة تحكيم، آثار التحكيم، تنفيذ أحكام التحكيم. |
| Description: | The topic aims to determine the meaning of arbitration to settle disputes of public-private partnership contracts of an international nature, and the legislator's position on the extent to which public-private partnership contract disputes of an international nature can be arbitrated, present the position of jurisprudence and the administrative judiciary, and determine the effects of arbitration and its role in resolving disputes of public-private partnership contracts of an international nature. The effectiveness of arbitration remains dependent on the extent to which the parties are committed to implementing the arbitrators' rulings and resolving disputes of public-private partnership contracts of an international nature.
