| Résumé: | منحت المادة 39 من ميثاق الأمم المتحدة مجلس الأمن سلطة تقديرية شبه مطلقة في تكييف الحالات المعروضة عليه، إذ يملك وحده سلطة تقرير ما إذا كان قد وقع تهديد للسلم أو إخلال به أو عمل عدواني، كما يملك سلطة عدم اعتبار الحالة كذلك، ولا يقيّده في ذلك أي قيد قانوني، إلا مبادئ وأهداف الأمم المتحدة والقواعد الإجرائية لاتخاذ القرار إن هو تمسك بها. على ذلك تتباين مواقف مجلس الأمن من حالة لأخرى بالنظر إلى ظروف كل منها، حسب ما يلحق السلام العالمي من تهديد وذلك بالنظر إلى مصدره وآثاره، بالإضافة إلى اعتبارات أخرى. |
| Description: | Article 39 of the United Nations Charter has given the Security Council an almost absolute discretion in adapting the cases presented to it; for it alone has the power to decide whether there has been a threat to the peace, breach of it, or an aggressive act. Moreover, it has the power not to consider the situation as such without any legal restriction, except for the principles and the procedural rules of the UN. Accordingly, the SC’s positions vary depending on circumstances, like considering the threat to world peace according to its source and effects, in addition to other considerations. ا |
