dc.description	The obligation of non-compete to protect the interests of the employer and his organization from the unfair competition that the worker may commit after the end of his employment contract has been found.this obligation was included in the obligation to preserve the secrets of the work.in the contract of employment.the duty of not to compete with the employer and not to harm him shall be extended during the implementation of the contract of employment based on the concept of good faith in the performance of the duties. After the expiration of the dependency association ,it becomes accurate to find a balance between the protecting the freedom of the worker and not competing the employer	en_US
dc.description.abstract	وجد إلتزام عدم المنافسة لحماية مصلحة صاحب العمل و مؤسسته من المنافسة غير المشروعة التي قد يرتكبها العامل بعد انتهاء عقد عمله ،وقد كان هذا الإلتزام مدرجا ضمن الإلتزام المتعلق بحفظ أسرار العمل ،حيث أدى الإفراط و التوسع في تطبيقه بحجة ضمان المحافظة على مصلحة العمل إلى إدراجه كشرط مستقل في عقد العمل .كما يعتبر واجب عدم منافسة صاحب العمل وعدم الإضرار به يمتد أثناء تنفيذ عقد العمل إنطلاقا من مفهوم حسن النية في تنفيذ الواجبات ،أما بعد إنقضاء رابطة التبعية فإن الأمر يصبح دقيق في إيجاد التوازن بين حماية حرية العامل في العمل وبين عدم منافسة صاحب العمل	en_US
