| Abstract: | تبنى المشرع الجزائري في القانون رقم 10-03 نمط الامتياز في استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة والذي منح بموجبه للمستثمر الفلاحي الحق في الاستغلال في شكل مستثمرة فلاحية، محافظا بذلك على ما جاء به القانون رقم 87-19 المتعلق بالمستثمرات الفلاحية، غير أنه أعطاها أهداف ذات أبعاد اقتصادية استثمارية بحتة تعتمد على المبادرة الشخصية للمستثمر الفلاحي وانسحاب الدولة من النشاط الفلاحي مكتفية بتوفير آليات الدعم، وتظهر من خلال النقاط الجديدة التي جاء بها القانون الجديد. |
| Description: | The Algerian legislator adopted in the law n= 10-03 the model of concession in the exploitation of agricultural lands belonging to the private property of the State, granting to the farmer the right to exploit in the form of agricultural investment, thus preserve the provisions of the law n= 87-19 relating to agricultural investments, except that it has attributed to them abjectives whose dimensions of the purely economic investment depend on the personal initiative of the agricultural investor and of withdrawal of the State from the agricultural activity by providing only support mechanisms and which appears through the new points brought by the new law. |
