| Abstract: | تهدف الدراسة إلى الكشف عن مظاهر الانحراف الدستوري في ظل تأثر سلطة تعديل الدستوري " السلطة التأسيسية " بنظام الأغلبية البرلمانية، و كذا في ظل هيمنة السلطة التنفيذية على نظام الحكم في الدول المعاصرة، وقد كشفت الدراسة عن إمكانية وجود انحراف السلطة التأسيسية عن القواعد فوق الدستورية، وعن الروح العامة للدستور، فضلا عن مخالفة سلطة التعديل للقيود الشكلية و الموضوعية المتعلقة بآليات تعديل الدستور. وانتهت الدراسة إلى اقتراح معيار موضوعي لمعرفة الانحراف الدستوري، وهو معيار مخالفة السلطة التأسيسية الفرعية لروح الدستور ومقاصده العامة. |
| Description: | The study aims to uncover the manifestations of constitutional deviation in light of the impact of the constitutional authority to amend the "constituent authority" system of parliamentary majority, The study revealed the possibility of deviation of the constituent authority from the supraconstitutional rules, the general spirit of the constitution, as well as the violation of the power of amendment to the formal and substantive restrictions related to the mechanisms of amending the constitution. The study ended with the proposal of an objective criterion for determining the constitutional deviation, which is the criterion of violating the constituent authority of the spirit of the constitution and its general purposes . |
