| Résumé: | إن حرية تأسيس الأحزاب السياسية تعتبر من بين الحريات العامة ذات الطابع السياسي الأكثر أهمية من حيث أنها إحدى الآليات الأساسية التي تحقق مبدأ سياسي هام وهو مبدأ التداول على السلطة، الذي يقوم على مشاركة المواطنين في تسيير الشؤون العامة للبلاد من خلال تولي المناصب في المؤسسات الدستورية التي يكون إسنادها عن طريق نمط الانتخاب سواء على المستوى الوطني أو المحلي. ولقد ضمنت الإعلانات و المواثيق والاتفاقيات الدولية هذه الحرية، وتم التنصيص عليها في دساتير الدول في جل دول العالم، لإضفاء الحماية القانونية عليها، باعتبار أن الدستور هو القانون الأسمى في الدولة، والذي يعلو جميع القوانين والتنظيمات، ومخالفتها له يترتب عليه الحكم بعدم دستوريتها، وتركت تنظيمها وضبطها للسلطة التشريعية النابعة عن الإرادة الشعبية. |
| Description: | The freedom to establish political parties is one of the most important political liberties in terms of one of the basic mechanisms that achieve an important political principle, the principle of power trading, which is based on the participation of citizens in the conduct of public affairs of the country by assuming positions in the constitutional institutions that Which should be supported by the electoral pattern, whether at the national or local level.
