| Abstract: | إن تطور الجريمة و استعمال التكنولوجيا في ارتكابها والتي أصطلح عليها بالجرائم المعلوماتية أو الافتراضية أو الالكترونية، واتساع رقعتها إلى العالمية أصبح سبب كافيا يستدعى التعاون الدولي سواء عمليا أو تشريعيا في مكافحة هته الجرائم والحد منها. وعلى الصعيد الداخلي نجد الدول قد عدلت من تشريعاتها حيث جرمت هته الأفعال التي لها نفس الأثر للجرائم التقليدية إن لم يكن أكثر حيث أصبحت تهدد كيان الدولة، من أجل ذلك كان لزاما على أجهزة الأمن تطوير كوادرها ووسائلها و الاستعانة بهياكل خاصة من أجل الكشف عن هته الجرائم وذلك بالكشف عن أدلتها والتي هي دلائل إلكترونية رقمية ستوجب الدراسة من حيث مدلولها وحجيتها وعناية التشريعات بها وهي الآثار التي يتركها المجرم في هذا النوع من الجرائم، وقبل التعرف على الادلة وجب علينا التعريج عن الجرائم التي تنتج هته الأدلة معرفة مفهومها وأنواعها كونها أساس للدليل الرقمي. |
