| Abstract: | لقد خول المشرع الجزائري صلاحية المتابعة الإدارية للممارسات المقيدة للمنافسة لمجلس المنافسة الذي يعد سلطة إدارية مستقلة تتولى مهمة السهر على السير الحسن للمنافسة في السوق، وقد أحاط إجراءات الدعوى أمام هذه الهيئة بمجموعة من الضمانات القانونية وحقوق الدفاع خلال مختلف المراحل سواء قبل الفصل في القضية أو بعد ذلك و التي لا تختلف في مجملها عن تلك المكرسة أمام الهيئات القضائية تحقيقا لشفافية المتابعة وعدالة الإجراءات وضمانا لحقوق المؤسسات الأطراف من التعسفات والتجاوزات التي قد تصدر من المجلس خلال ذلك. |
