dc.description	The purpose of this research is to show the extent of the authoritative title of the property law created by the Algerian legislator through Decree No. 73-32 concerning the establishment of private property rights, even before it finds the mechanism of legal embodiment that has not been published for more than two years under Order 75-74 The preparation of the survey of public lands and the establishment of the land registry, which was not organized as well after more than a year by Decree No. 76-62, which includes the preparation of land survey and Decree No. 76-63 concerning the establishment of land registry. Since real estate ownership is not only evidenced by the mortgage in the surveyed areas, it was necessary to identify the criterion taken by the legislator whether this absolute or relative, and the compatibility of the position of the judiciary with the provisions issued in respect of the disputes that have been offered to him	en_US
dc.description.abstract	يهدف هذا البحث إلى إظهار مدى حجية الدفتر العقاري الذي أوجده المشرع الجزائري من خلال المرسوم رقم 73-32 المتعلق بإثبات حق الملكية الخاصة، حتى قبل أن يجد له آلية التجسيد القانونية التي لم ترى النور إلا بعد ما يزيد عن سنتين بموجب الأمر 75-74 المتضمن إعداد مسح الأراضي العام وتأسيس السجل العقاري، والذي لم ينظم كذلك إلا بعد ما يزيد عن السنة بالمرسوم رقم 76-62 المتضمن إعداد مسح الأراضي والمرسوم رقم 76-63 يتعلق بتأسيس السجل العقاري. بما أن الملكية العقارية أصبحت لا تثبت إلا بالدفتر العقاري في المناطق الممسوحة، فكان من الضروري معرف المعيار الذي أخذ به المشرع ما إذا كانت هذه الحجية مطلقة أم نسبية، ومدى انسجام موقف القضاء معه من خلال الأحكام الصادرة في حق ما ثار من منازعات التي عرضت عليه.	en_US
