Abstract:	يعتبر التفتيش من أخطر الإجراءات وأهمها وذلك لعدم إقتصار على تقييد حرية الأفراد فقط بل يتجاوزها إلى خرق حصانة مساكنهم التي تعد من أبرز صور الحق في الحياة الخاصة، وعليه فالتفتيش هو إجراء ضروري لأنه يؤدي إلى الكشف عن الأدلة المادية للجريمة ما لم تتمكن السلطة الخاصة بالتحقيق من ضبط هذه الأدلة، ولذلك فإن المشرع الجزائري على غرار باقي التشريعات الحديثة نظم قواعد التفتيش وفق مجموعة من الإجراءات من أجل صيانة حقوق الأفراد وعدم التعسف في التدخل في خصوصياتهم إلا إذا كان هناك مبرر، وفي الحدود التي بينها القانون وفق قواعد وشروط محددة، ومتى تم إهمالها أو عدم مراعاتها فإنها تؤدي للبطلان
Description:	The inspection is one of the most serious and most important measures, not only to restrict the freedom of individuals but also to violate the immunity of their homes, which is one of the most prominent forms of the right to private life. Therefore, inspection is necessary because it leads to the disclosure of material evidence of the crime. The Algerian legislator, like the rest of modern legislation, has set up rules of inspection according to a set of procedures to safeguard the rights of individuals and not to interfere in their privacy unless there is justification, within the limits of the law according to specific rules and conditions, Or p M taken into account, they lead to invalidity
