| Abstract: | يشكل الأجر الوطني الأدنى المضمون أحد أقسام الأجر ويختلف عن الأقسام الأخرى كونه من النظام العام الاجتماعي يقره التشريع وتحدده السلطة وفقا للقدرة الشرائية للعمال ليضمن القدر الأدنى من المعيشة. شكل تحديد القيمة المالية للأجر الوطني الأدنى المضمون ومحتوياتها مشكلات كبيرة في الأوساط العمالية سواء تعلق الأمر بمضمون الأجر ذاته أو لعدم تناسب قيمته مع القدرة الشرائية، مما رفع سقف المطالب النقابية وصعد من الاحتجاجات العمالية في الآونة الأخيرة للمطالبة بإلغاء النصوص التي تحدد مضمون الأجر الوطني الأدنى المضمون(المادة 87 مكرر)، ولم يسعف تدخل الدولة من حين لآخر في رفع قيمته منذ سنة 1963 وزادت وتيرة الرفع من قيمة الحد الأدنى في السنوات الأخيرة وفي فترات متقاربة كما زاد الأمر تعقيدا التخبط الذي وصلت إليه السلطة التنفيذية في الأشهر الأخيرة حين تقوم بإلغاء النص القانوني المحدد لمضمون الأجر الوطني الأدنى المضمون أحيانا وتقوم بتعديله أحيانا أخرى عن طريق تعديل محتوى الأجر الأدنى المضمون بالاعتماد على مكوناته، فهل سيلبي المحتوى الجديد للأجر الأدنى المضمون مطلب توفير القدرة الشرائية للعمال؟ |
