| Abstract: | من خلال استقراء نصوص المرسوم التنفيذي 18-213 المحدد لشروط وكيفيات استغلال العقارات الوقفية الموجهة لإنجاز مشاريع استثماريه، يتضح أن سياسة الدولة الجزائرية والقائمين على المؤسسة الوقفية تتجه إلى الاعتماد على أنجع الأساليب الاستثمارية لتنمية الثروة الوقفية التي تملكها الجزائر خاصة العقارية منها، بما يضمن مساهمة هذه الأملاك الوقفية في تحقيق التنمية الاقتصادية، لا سيما في الوقت الراهن الذي تشهد فيه الجزائر تحولات اقتصادية أقل ما يمكن القول عنها أنها تعرف تردي نتيجة اعتمادها على الثروة النفطية كأساس للنهوض بالاقتصاد الوطني، الأمر الذي يتم معه ضرورة البحث عن بديل اقتصادي آخر غير الثروة النفطية وتكون ذات طابع مستدام، والتي منها قطاع الاستثمار الوقفي الذي طالما اعتبر أحد الحلول البديلة في الاقتصاد الإسلامي، وهو ما تم تكريسه بموجب هذا المرسوم |
| Description: | Trough the extrapolation of the provisions of the executive decree establishing the conditions and ways for the exploitation of the real estate destined for the execution of investment projects, it seems clear that the state policy intends to rely on the most effective investment methods for the development of the real estate property owned by it. Thereby, this ensures the contribution of real estate in achieving economic development. In particular, at the present time, when Algeria is experiencing deteriorating economic transformations as a result of its dependence on oil wealth as a basis for the advancement of the national economy, the need to find another economic alternative other than oil wealth that is of a sustainable nature is essential. This also includes the endowment (Wakf) investment sector that has been considered one of the alternative solutions in the Islamic economy. |
