| Abstract: | العقد الالكتروني لا يختلف عن العقد العادي في أركان انعقاده و شروط صحته،والأثر المترتب عليه من حيث المسؤولية إذ يختلف عنه في الوسيلة التي يبرم بها ،و يخضع للقواعد العامة في تنظيمه ومراعاة خصوصيته، لأنه يعتبر عقد يبرم عن بعد باستخدام وسائط الكترونية حديثة ، لذلك فهو يتطلب وسط قانوني قوي محاط بالعديد من الضمانات ، لكي تكون حماية المستهلك البسيط عن طريق معرفة ماله من حقوق وما عليه من واجبات لنضمن السير الجيد للمعاملات الالكترونية. |
