| Résumé: | إن تفويض المرفق العام المحلي هو أحد الآليات الواعدة في يد السلطات المحلية من أجل تحقيق التنمية فهو يتيح لها إمكانية استخدام الاستثمار الخاص لإدارة خدماتها العامة دون إثقال ميزانيتها . بعد فترة طويلة من تجاهل هذه التقنية من قبل القانون الجزائري أي طوال فترة الإشتراكية وحتى بعد الانتقال الى اقتصاد السوق بسنوات وإلى غاية صدور المرسوم التنفيذي 15-247 المتعلق بالصفقات العمومية وتفويضات المرفق العام و المرسوم التنفيذي 18-199 واكتمال النظام القانوني لعقود تفويض المرفق العام وهو ما يفتح المجال لإعمالها من أجل تنمية محلية حقيقية |
| Description: | The delegation of public service is one of the promising procedures in the hands of local authorities in order to achieve the development of their territories. It allows them to use private investment to manage their public services without increasing their budgets. Long neglected, the delegation of public service finds its place, especially after the adoption of Executive Decree 18-199 which complements the legal regime established by Decree 15-247. Thus the legal framework of the delegations is completed. |
