dc.description	The rule of custom in the El-Maliki fatwa and its Impact on the Aspect of Jurisprudence in the Islamic West Arabized Standard of the Wencharissi as a Model Abstract: Islamic law came and a lot of human norms inherent in the soul. It followed a sage attitude characterized by gradation and depth of treatment, and identified a general framework. It did not allow for such usages to surpass it regardless of the degree of strength in the soul. It kept the practices belonging to divine rules and built on a lot of Judgments, while it excluded all what infringed law wisely and deliberately. dc.description.abstract	جاءت الشريعة الإسلامية والكثير من الأعراف البشرية متأصلة في النفوس، فسلكت معها مسلكاً حكيماً يتسم بالتدرج وعمق المعالجة، وحددت إطاراً عاماً، لم تسمح لتلك الأعراف بتجاوزه مهما بلغت درجة قوتها في النفوس؛ فأبقت على الأعراف الموافقة للتعاليم السماوية، وبنت على بعضها الكثير من الأحكام، في حين استبعدت ما خالف الشرع بحكمة وروية. وقد أوضح الونشريسي من خلال بعض النوازل والفتاوى الفقهية العديد من العادات والتقاليد والأعراف المغربية في العصر الإسلامي، والتي تتوافق مع الشرع، والأخرى المنافية له، منها عادة الجهر بالتهليل أمام الجنائز، والاحتفال بالمولد النبوي الشريف، والاحتفال بميلاد أطفالهم.	en_US
