dc.description	The property investment and a make use is considered as a power of the owners, also among the forceful points included in low 29-90. Specifically about property development like building operations were organized and supervised by different legal texts concerning urban development. The legal ways of building operation and the system of border demarcation were clarified in the urbanisation and arrangement lows, the building is also provided to obtain « building permit », in addition, conformity certificate is obliged to ensure that these procedures had been respected. Finally, all these procedures of building from the beginning until the end were ordered by legislator, by writing, they write reports if it will be irregular concerning building permit to follow theme judiciously.	en_US
dc.description.abstract	يعتبر التصرّف في الملكية العقارية واستعمالها وممارسة جميع الأنشطة عليها من أهم الحقوق المكفولة دستورياً للمالك، ومن بين أهم تلك التصرفات التي تطرأ على العقار هي عمليات البناء التي نظّمتها وأطّرتها مختلف النصوص القانونية المتعلّقة بالتهيئة والتعمير وبالأخص القانون رقم 90-29. حيث تكفّلت قوانين التهيئة والتعمير، بتوضيح طرق القيام بعمليّة البناء ورسم حدودها ضمن مخططات التهيئة والتعمير من خلال تقييد عمليّات البناء بشرط الحصول على رخصة تسمح به، بالإضافة إلى ضرورة مطابقة أشغال البناء للتأكّد من احترام التعليمات والمواصفات والشروط الواردة في رخصة البناء، كل ذلك جاء من أجل ضمان ممارسة عقلانية لهذا الحق الدستوري. كما أحاط المشرّع تنفيذ تلك الشروط بعمليّات مراقبة، يتولاّها أشخاص مؤهّلون قانوناً لمتابعة عمليّات البناء منذ تنفيذها إلى غاية انتهائها، وتحرير محاضر ذات حجية في حالة ما إذا تبث لديهم وجود مخالفات تتعلق برخص البناء، حتى يتم تفعيل إجراءات المتابعة بحق المخالفين وتسليط مختلف العقوبات الردعية بحقّهم	en_US
