| Résumé: | تعتبر الملكية العقارية من أهم الثروات التي يقوم عليها النظام الاقتصادي، ونظرا لأهمية العقار في تحقيق التنمية الاقتصادية والاجتماعية ولارتباطه الوثيق بالنظام السياسي في الدولة، فإنّ طريقة استغلاله تعد قضية جوهرية تتحكم في حاضر الشعوب ومستقبلها، ولقد أصدر المشرع الجزائري منذ الاستقلال مجموعة من النصوص القانونية التي تنظم الملكية العقارية والملائمة للتوجه الاشتراكي الذي انتهجته الجزائر آنذاك، والذي يمجّد الملكية الجماعية على حساب الملكية الفردية التي همّش دورها، والذي يفرض القيود عليها لصالح الملكية الجماعية لوسائل الإنتاج. |
| Description: | Real estate is one of the most important assets on which the economic system is based. Considering the importance of real estate in achieving economic and social development and its association with the political system in the state, its method of exploitation is a fundamental issue that controls the present and future of peoples. Real estate property that is appropriate to Algeria’s socialist orientation at the time, which glorifies collective ownership at the expense of individual ownership that has marginalized its role and imposes restrictions on it for the collective ownership of the means of production. |
