| Abstract: | لا يمكن إنكار حقيقة أن الشركاء في الشيوع يريدون إنهاءه -لما يكون قد أصابهم من مشاكل -الشيء الذي يؤثر على الانتفاع به- لدى وجدت فكرة قسمة المهايأة والتي هي قسمة انتفاع لا قسمة ملكية. فكييف ينظم الانتفاع بالشيوع عن طريق هذه القسمة ( المهايأة) و في الاخير يبقى عقد هذه القسمة اتفاق مؤقت يراد به الانتفاع بالشيء الشائع ومن تم لا ينتهي الشيوع بين الشركاء. |
| Description: | It is an undeniable fact that partners in the common want to end it for the problems they have encountered, which affects its use. So the idea of provisional sharing has been found instead of the property division so how can the common use by the indivision be regulated through this division-provisional- and finally the contract remains. Temporary amicable sharing is intended for the usufruct of the common thing. So the indivision between partners does not end. Key words: the usufruct, common property , rotation |
