Abstract:	إن حيازة الجزائر لمجموعة من الأملاك على تنوعها دفع بالمشرع الجزائري للتفكير في وضع نظام خاص بها ، يفيد حمايتها و الحفاظ على ضمان الاستعمال الجماعي لهذه الأملاك،معتبـرا الإدارة الطرف الرئيســــي في حماية الملك العـــــام و صيانته كلما استدعـــــت الضرورة ذلك ، و الحفاظ على حـــــق المواطن في الانتفاع به ، مقابل عدم إتلافه أو التعدي عليه . كما منح تشريع الأملاك الوطنية حق الإدارة في ربط علاقة قانونية مع شخص طبيعي أو شخص معنوي من أشخاص القانون العام أو القانون الخاص من أجل تسيير و استغلال الأملاك العامة للدولة ، سواء بموجب ترخيص أو بإبرام عقد امتياز ، مع ممارســـــة الإدارة مهمة مراقبة المتعامل معها ، في إطار عدم تعارض هذا الاستعمال الخاص مع الهدف الأول و الرئيسي تحقيق المنفعة العامة
Description:	Algeria's possession of a variety of properties has prompted the Algerian legislator to consider setting up a system of its own that would protect and preserve the collective use of these properties, considering that the administration is the main party in the protection and maintenance of the public domain whenever necessary. The national property legislation also grants the management the right to establish a legal relationship with a natural person or a legal person from public law or private law for the management and exploitation of the public property of the State, whether under license or the conclusion of a concession contract. The framework of non-conflict of this particular use with the first objective and the main public benefit. Key Words: Public Domain - Public Utility - Individual Utility
