dc.description	The lease sale contract is one of the real estate promotion contracts established by the Algerian legislator, although it was not stipulated in the legal provisions relating to the activity of real estate promotion, the most recent of which was Law No. 11/04, but this type of contract was introduced under Executive Decree No. 01/105, which specified the conditions for the purchase of houses completed with public funds in the context of the sale of rent and the conditions of that rate and the completion of, which allows individuals to acquire ownership of a dwelling. What is striking to the analysis are the special conditions governing this contract to make it a contract distinct from other contracts that are practically and legally familiar, whether in view of its legal nature as a composite contract or in view of the legal implications it has on the beneficiary.	en_US
dc.description.abstract	يعتبر عقد البيع بالإيجار من بين عقود الترقية العقارية التي كرسها المشرع الجزائري ، بالرغم من أنه لم ينص عليه ضمن الأحكام القانونية المتعلق بنشاط الترقية العقارية و التي كان أخرها القانون رقم 11/04 ، إلا أنه قد استحدث هذا النوع من العقود بموجب المرسوم التنفيذي رقم 01/105 المحدد لشروط شراء المساكن المنجزة بأموال عمومية في إطار البيع بالإيجار و كيفيات ذلك المعدل والمتمم ، و الذي يسمح للأفراد من الحصول على ملكية مسكن . ومما هو ملفت للتحليل هي الشروط الخاصة التي تنظم هذا العقد لتجعله عقدا مميزا عن باقي العقود المألوفة عمليا و قانونيا ، سواء كان ذلك بالنظر إلى الطبيعته القانونية باعتباره عقد مركب أو بالنظر إلى الآثار القانونية التي يرتبها على عاتق المستفيد	en_US
