| Abstract: | عقد المقاولة هو اتفاق بين المقاول ورب العمل على أن يقوم المقاول بعمل معين لصالح رب العمل في مقابل أجر يدفعه صاحب العمل، ويرتب عقد المقاولة على عاتق المقاول التزامات تتمثل في الالتزام بإتمام وإنجاز العمل ، والالتزام بتسليم العمل ، والالتزام بضمان سلامة البناء من المخاطر التي قد يتعرض لها خلال فترة الضمان ، وهو التزام مستقل عن الالتزام بإقامة أو تشييد البناء ، وقد اهتم المشرع الجزائري على غرار باقي التشريعات بالالتزام وخصه بمجموعة من النصوص في القانون المدني ، حيث ألزم كل مقاول بضمان الأعمال التي يقوم بها حتى بعد تسليمها لرب العمل وذلك لخطورة النتائج التي قد تترتب على عدم سلامة المباني . ويرتب الإخلال بهذه الالتزامات مسؤولية على عاتق المقاول قد تكون عقدية أو تقصيرية. |
| Description: | The contract of contract is an agreement between the contractor and the employer, provided that the contractor performs a specific work in favor of the employer in return for a wage paid by the employer.
