| Résumé: | رخصة البناء هي وثيقة رسمية تمنح لشخص طبيعي أو معنوي لغرض إقامة بناء جديد مهما كانت أهميته ، تصدرها سلطة مختصة بعد موافقة المصالح التقنية بمديرية البناء والتعمير بعد إتباع إجراءات معينة، يعد طلب الحصول على رخصة لبناء إجراء أولي وضروري لابد منه. يمكن للمستثمر صاحب الامتياز القيام بكل تهيئة أو بناء يراه ضروريا لاستغلال أفضل للأراضي الفلاحية ، غير أن هذا الحق مرتبط بترخيص مسبق من الديوان الوطني للأراضي الفلاحية الذي يعلم بدوره إدارة أملاك الدولة بذلك كإجراء سابق وإلزامي قبل الحصول على رخصة البناء. الكلمات المفتاحية: عقد الامتياز ، رخصة البناء ، المستثمر، العقار الفلاحي |
