| Abstract: | يعتبر حق الملكية من الحقوق العينية الأصلية التي حظيت باهتمام كبير من مختلف التشريعات ، غير أن قداسة هذا الحق وما يولده من سلطات للمالك لم ينفي خضوعه لقيود قانونية تتنوع بين تلك المقررة لحماية المصلحة العامة وأخرى لحماية المصلحة الخاصة لملاك العقارات المتلاصقة أو غير المتلاصقة . ونظرا لما يولده التلاصق في الأملاك العقارية من نزاعات كثيرة بين الجيران فقد قيد المشرع الجزائري سلطة الملاك والمنتفعين فيها، حيث تنوعت هذه القيود باختلاف ظروف التلاصق بين تلك المتعلقة بضبط حدود الملكيات العقارية المتلاصقة من جهة وتلك المرتبطة بإحداث الفتحات عند استغلال المالك لملكيته من جهة أخرى ، وهذا من أجل بسط الحماية القانونية اللازمة لحقوق الأفراد وملكياتهم الخاصة لدرأ أي نزاع أو تعدي عليها وتحقيق التوازن بينها وبين المصلحة العامة . وفي هذا الصدد جاءت هذه الورقة البحثية لدراسة قيود الجوار بسبب تلاصق الأملاك العقارية من مختلف الجوانب انطلاقا من مفهومها ، شروطها، أحكامها والنزاعات المترتبة عنها وكيفية حلها. |
| Description: | The right of ownership has received considerable attention from various legislations. They tried to restrict the authorities of private owners by passing a set of rules varying between those designed to protect public interests and others to preserve the private interests of adjacent or non-adjacent property owners. As far as adjacent neighbours are concerned, restrictions depend on whether properties have been already built or no. Accordingly, Algerian legislator would oblige owners to delineate boundaries in the non- built estates or to build a wall in the built-up ones. Not only this, but he also govern the way openings are made if they were windows or balconies. This is in order to prevent any kind of disputes and to make a balance between private and public interests as well. In this regard, this research paper aimed at studying the neighborhood restrictions from different aspects namely: its definition, its terms, its provisions and how to solve conflicts arisen from neighbouring properties. |
