| Résumé: | نظرا للأهمّية التي تكتسيها رخصة البناء باعتبارها آلية قانونية لممارسة حق البناء من جهة وحماية البيئة بما فيها المحافظة على تخصيصات الأراضي والأمن الإنساني من جهة ثانية، خصّت بهذه الدراسة لبيان الأحكام القانونية المتعلّقة بها، بدء بتعريفها، بيان خصائصها، ونطاق تطبيقها، ثم إجراءات البت في طلبها، وأخيرا بيان الآثار المترتبة عنها، مستخلصين من كل ذلك مدى فاعليتها كآلية وقائية من آليات الضبط الإداري لضمان حماية كلّية وفعلية للبيئة الحضرية وتخصيصات الأراضي والأمن الإنساني |
| Description: | In view to the importance of the building permit as a legal mechanism for the exercise of the right of construction on the one hand and the protection of the environment, including the preservation of land allocations and human security, on the other hand, this study is related to the legal provisions related to it, beginning with its definition, Its request and, finally, a statement of its implications, drawing on its effectiveness as a preventive mechanism of administrative control mechanisms to ensure full and effective protection of the urban environment, land allocation and human security. |
