| Résumé: | لقد أصبحت حركة العمران مقيدة بمقتضيات حماية البيئة، إذ لم تعد التشريعات البيئية تقتصر لوحدها على هذه الحماية، بل حتى التشريعات الخاصة بالعمران أو ذات الصلة به، ضمنت أحكامها مراعاة الجانب البيئي،، عن طريق وسائل قانونية محددة، بما يضمن حماية البيئة والمحافظة عليها، خاصة في ظل انتشار حركة التوسع العمراني والبناء غير الشرعي. وعليه فإن موضوع قواعد التهيئة والتعمير في تحقيق التوازن بين حماية البيئة والتنمية المستدامة هو موضوع حساس يقتضي مراعاة هذه القواعد للموازنة بين عمليات التهيئة والتعمير قصد الوصول إلى تنمية عمرانية مستدامة. |
