| Abstract: | تتضمن دراسة الحماية الإجرائية اولموضوعية للطفل الجانح مثلما اقرها المشرع الجزائري في القانون 15 / 12 المتعلق بحماية الطفل، حيث انصبت هذه الدراسة على تحليل النصوص والمواد القانونية من اجل حماية هذه الفئة الضعيفة من المجتمع، ومعرفة إن كان المشرع قد وفق حقا في توفير حماية كافية للأطفال الجانحين من الجانبين الموضوعي والإجرائي. وقد تضمن الفصل الأول ملخص وجيز حول مفهوم الطفل وأنواعه كما تطرقنا إلى تحديد مفهوم الطفل الجانح وما هي أسباب وعوامل جنوحه. أما الفصل الثاني تضمن الحماية القانونية للطفل الجانح و المتمثلة في صنفين وهما حماية موضوعية وحماية إجرائية. فالحماية الموضوعية تتمثل في ضرورة الربط بين سن الطفل و بين التدرج في المسؤولية الجنائية في القانون 15 / 12 المتعلق بحماية الطفل. أما بالنسبة للحماية الإجرائية للطفل تسعى إلى عدم تسليط العقوبة على الطفل الجانح رغم ارتكابه للفعل المنحرف، وإنما تسعى إلى إدماج الطفل داخل المجتمع. |
| Description: | The study of the procedural and substantive protection of the Child in conflit with the Law 15/12 on the protection of the Child, This study focused on the analysis of legal texts and materials in order to protect This vulnerable group of society, and whether the legislator had passed a right to provide adequate protection for children in conflict with the law on both the substantive and procedural aspects. Chapter 1 contains a brief summary of the concept of the Child and its types, as well as the definition of the concept of the Child in conflict with the Law and the causes and factors of delinquency. Chapter 2 guatantees the legal protection of the Child in conflict with the Law in two categories substantive protection and procedural protection. Objective protection is the need to link the age of the Child with the gradient of criminal responsability in law 15/12 on Child perptection,as for procedural protection of the Child, it sought not to punish the Child in conflict with the Law, but rather to integrate the Child into society. |
