| Résumé: | باعتبار أن الطفل احد الخلايا المهمة وحساسة في قيام المجتمع. فقد اوجب المشرع قرض حماية خاصة لحمايته، للتقليل من ظاهرة الانحراف التي تسود المجتمعات والتي تنذر بخطر داهم إذا لم تم التصدي لها. فالحق في حماية الطفل من ابسط واهم الحقوق التي جاء بها القانون ذلك أن عدم توفير هذه الحماية قد تدفع الطفل إما لتعرض الطفل للخطر أو الانحراف والإجرام وحتى في حال قيامهم بذلك فان المشرع الجزائري خصهم بأولويات وضمانات تتناسب مع هذه الفئة .كما عمل أيضا على جمع كل من الحماية الاجتماعية والحماية القضائية وجعلهما يخدمان كل من نفسية الطفل سمعته والحرص على حمايته حتى بعد ارتكابه للفعل المجرم بعدم السماح بنشر المعلومات التي تخص الطفل والتكتم على كل ما من شانه أن يؤذيه وهو ما تم التطرق إليه في دراستنا المتعلقة بالتعامل الجنائي مع الطفل المعرض للخطر المعنوي. |
| Description: | The child is one of the most important and sensitive cells in society. In order to minimise the phenomenon of delinquency, which is prevalent in societies and poses an imminent danger if it is not addressed, the legislator required a special protection loan to protect the child. The right to protect the child is one of the simplest and most important rights enshrined in the law, as the failure to provide this protection may push the child to either endanger, delinquency or criminality, and even if they do so, the Algerian legislator has prioritised them with priorities and guarantees commensurate with this category. He also worked to combine both social protection and judicial protection and make them serve both the child's psyche and reputation and ensure that he is protected even after committing the criminal offence by not allowing the publication of information concerning the child and concealing everything that could harm him, which was addressed in our study on the criminal treatment of the child at moral risk |
