| Résumé: | المسؤولية الجزائية الناشئة عن تقنية الذكاء الإصطناعي في القانون الجزائري هي قضية معقدة ، نظرا للخصائص الفريدة لأنظمة الذكاء الإصطناعي في القانون الجزائري ، تتطلب المسؤولية الجزائية تقليديا اسنادا واضحا للنية او الاهمال الى فاعل بشري ، ومع ذلك فان انظمة الذكاء الاصطناعي ، التي يمكن ان تعمل بشكل مستقل وتتخذ قرارات بدون تدخل بشري ، تتحدى هذا الإطار التقليدي. |
| Description: | The criminal liability arising from artificial intelligence (AI) technology in Algerian law is a complex issue, given the unique characteristics of AI systems. In Algerian law, criminal liability traditionally requires a clear attribution of intent or negligence to a human actor. However, AI systems, which can operate autonomously and make decisions without human intervention, challenge this traditional framework. The main legal questions revolve around how to attribute liability when AI systems cause harm. Possible approaches include holding the designers, programmers, or operators of AI systems accountable, depending on their role in the development and deployment of the AI. Another consideration is the extent to which existing legal principles, such as negligence or strict liability, can be adapted to address harms caused by AI. Algerian law, like many other jurisdictions, is still developing in response to these challenges. There is a need for specific legislation that addresses the unique issues posed by AI, balancing innovation and safety while ensuring that victims of AI-related harm have a clear path to redress |
