| Résumé: | إن فكرة التضامن تعد أحد المواضيع الأكثر أهمية في القانون المدني ، ونظرا لقوته التأمينية التي تهدف الى تأمين الوفاء بالدين كان حري بنا التطرق الى ضرورة الوقوف على اخراج القواعد والاحكام الشرعية الخاصة به في الفقه الإسلامي اذ يحقق هذا النظام امتيازات لأصحاب الحق و للملتزمين بهذا الحق سواء من الناحية القانونية أو الشرعية باعتبار ان المبادئ التي تقوم عليها هاته الأخيرة في احكامها العامة من وجهة القانون المدني لا تتنافى مع ما هو مقرر في الحكم الشرعي ، أما بالنسبة لأصحاب الحق يطلق على تضامنهم بالتضامن الإيجابي ، أما بالنسبة للملتزمين بالحق فيطلق على تضامنهم بالتضامن السلبي ، وبهذا النظام يكون لأصحاب الحق مجتمعين أو أيا منهم سلطة الخيار في مطالبة الملتزمين جميعا أو أيا منهم بكامل هذه الحقوق ، كما يكون للملتزمين جميعا أو أيا منهم عن طريق هذا النظام أن يؤدي هذه الحقوق كاملا لجميع أصحابها أو لأي واحد منهم يختاره الملتزم لقبض هذه الحقوق ، و بما أن هذا النظام التزام تأميني يستوجب الخضوع لأحكامه متى قام |
| Description: | The concept of solidarity is one of the most important topics in civil law, given its insurance strength aimed at ensuring debt repayment. Therefore, it was necessary for us to address the need to examine the extraction of rules and legal provisions related to it in Islamic jurisprudence. This system provides advantages to rights holders and those obligated to fulfill these rights, whether from a legal or Sharia perspective, as the principles underlying these provisions generally do not conflict with Sharia rulings from the standpoint of civil law. As for rights holders, their solidarity is termed positive solidarity, while for those obligated to the right, it is termed negative solidarity. Under this system, rights holders collectively or individually have the authority to demand full rights from all obligated parties or any one of them. Similarly, through this system, obligated parties collectively or individually may fulfill these rights entirely for all their holders or for any one of them chosen by the obligated party to receive these rights. Since this insurance commitment system requires adherence to its provisions whenever applicable |
