| Résumé: | نستخلص من هذا الموضوع أنّ من العدالة والأصل في المحاكمات ألّّا يصدر الحكم الجزائي إلا بعد سماع أقوال المتّهم والخصوم حتّى يصبح عنوانا للحقيقة، وإن لم يكن كذلك فسيصبح من أضعف الأحكام دلّالة على ما قضي به لأنّ المحكوم عليه لم تتح له فرصة الدّفاع عن نفسه، إلّّا أنّ الواقع العملي حتّم على المشرّع الجزائري تبني فكرة المحاكمة الغيابية رغم صحّة التكليف بالحضور الموجّه للمتّهم، كسبيل لتطبيق القانون في موعده، وإن خلت هذه المحاكمة من أهمّ الضمانات المكفولة للمتّهم بسبب غيابه، إلّّا أنّ المشرّع عوّضه بضمانات أخرى للمساواة بين الحقوق عن طريق إعطائه فرصة ثانية وإعادة محاكمته مجدّدا على أساس المعارضة وفق شروط معيّنة نصّ عليها قانون الإجراءات الجزائية الجزائري، وفي حالة مخالفتها يستعيد الحكم الغيابي قوّته وتصبح المعارضة كأن لم تكن |
| Description: | We conclude from this topic that it is a matter of justice and principle in trials that a criminal sentence should be issued only after hearing the statements of the accused and the opponents so that it becomes the title of the truth, and if not, it will become one of the weakest sentences indicative of what was decided because the convict did not have the opportunity to defend himself, but the practical reality made it imperative for the Algerian legislator to adopt the idea of trial in absentia, despite the validity of the assignment of attendance to the accused, as a way to apply the law on time, and if this trial lacks one of the most important guarantees guaranteed to the accused due to his absence, but the legislator with other guarantees of equal rights by giving him a second chance and re-trying him again on the basis of opposition under conditions Certain provisions of the Algerian Criminal Procedure Code, and in case of violation of them, the ruling in absentia regains its strength and the opposition becomes as if it were not. |
