| Résumé: | تعتبر المحاكمة الجنائية عن بعد من أهم ما توصل إليه العالم من تطور التكنولوجيا وتعدد وسائلها ، حيث أصبح من الضروري اللجوء إلى المحاكمة الجنائية عن بعد خاصة في الآونة الأخيرة وتماشيا مع التدابير الاحترازية للحد من انتشار الأوبئة والفيروسات مثل فيروس كوفيد 19 في الجزائر. فهذه الأخيرة هي تقنية لتفعيل عصرنة العدالة على أرض الواقع والحفاظ على سيرورة مرفق القضاء وتطبيق العدالة، فنجد ان المشرع الجزائري اتجه نحو إصلاح العدالة وتحسين أداءه عن طريق إصدار قوانين تتيح للمؤسسات القضائية استعمال التكنولوجيا الرقمية الحديثة، واستعمال آليات متطورة على شاكلة مرفق عمومي الإلكتروني يقدم خدماته بشكل عادي . وقد خطى المشرع الخطوة كبيرة في سبيل تكريس ذلك خاصة بعد صدور القانون 15 / 03 المتعلق بعصرنة العدالة والذي أقر في أحكامه استعمال عدة تقنيات الإلكترونية في قطاع العدالة على غرار التصديق الإلكتروني و المحادثات المرئية عن بعد |
| Description: | Remote criminal trial is considered as one of the most things that the world has reached from the development of technology and its means. It has become necessary to deal with it, especially in recent times and in line with the precautionary measures to reduce the spread of pandemics and viruses such as Covid 19 in Algeria. The latter is a technique to activate the modernization of justice on the ground and to preserve the process of the judiciary and the application of justice. That’s why the Algerian legislator has moved towards reforming justice and improving its performance by issuing laws that allow judicial institutions to use modern digital technology and the use of modern mechanisms in the form of an electronic public utility that provides its services normally. The Algerian legislator has taken the big step in order to devote this, especially after the issuance of the law 15/03, which is related to the modernization of justice, which approved in its provisions the use of several electronic technologies in the justice sector, such as electronic certification and remote video chats. This latter, which was consecrated as a practical result of Algeria signing several agreements, is a technique that solves many procedural problems that were facing the justice sector, especially in the stages of criminal investigation and criminal trial, and thus represents one of the effective and alternative means that contribute to speeding up procedures, reducing expenses and protecting witnesses. And experts and victims of crimes, and guarantee the rights and freedoms of the accused until he is acquitted or convicted |
