| Résumé: | إن حتمية مسايرة المجال الطبي للتقدم العلمي، كان له تأثيرا واضحا في تغيير صورة العلاقة الطبية، بحيث أصبح مبدأ الخيرة بين البعد التعاقدي والتنظيمي في السنوات الأخيرة متجاوزا باعتباره تصور تقليدي مثلما تم تجاوز التقسيم بين القانون العام والخاص. على هذا الأساس أضحى تحديد معالم هذه العلاقة موضوعا متجدّدا قد دفعت إلى تطوره جهود فقهية قضائية حثيثة على نحو أبرز لهذه العلاقة منحى خاص يحمل طابعا إنسانيا من ناحية الأطراف المكونة لها ومهنيا من حيث ما تتضمنه من التزامات تفرضها قواعد مهنة الطب وأخلاقيتها في سبيل تحسين الخدمات الطبية عن طريق رعاية الطرف الضعيف وكذا تعزيز حماية المركز القانوني للمريض |
| Description: | The inevitability of the medical field to keep pace with scientific progress has had an impact in changing the concept of the medical relationship. The principle of goodness between the contractual and organizational dimension has become overridden just as the division between public and private law has been overlooked. Defining the features of this relationship has become a renewed topic that has prompted the development of jurisprudential efforts in a more prominent manner for this relationship with a special aspect, bearing a human character in terms of its constituent parties and professionally in terms of the obligations it imposes, by medical ethics in order to improve medical services and enhance legal protection for the patient. |
