| Résumé: | اقر المشرع الجزائري بموجب القانون رقم 22/16 المتمم للقانون رقم 90/11 المؤرخ في 21/04/1990 المتعلق بعلاقة العمل عطلة خاصة تحت مسمى عطلة لإنشاء مؤسسة، وما يميزها أنها عطلة بدون أجر يستفيد منها العامل مرة واحدة خلال حياته المهنية، بهدف خلق مناصب الشغل وتفعيل روح المبادرة الاقتصادية. وأثناء فترة عطلة لإنشاء مؤسسة تكون علاقة العمل معلقة، إذ أن المشرع الجزائري أدرجها ضمن حالات تعليق علاقة العمل بموجب المادة 03 من القانون 22/16 التي تممت المادة 64 من القانون 90/11. وتجدر الإشارة الى أن العامل يستفيد من حقوق أثناء سريانها، من أهمها احتفاظه بمنصب عمله، والرجوع اليه مباشرة بعد نهاية مدتها، وفق شروط منصوص عليها قانونا |
| Description: | According to Law no 16/22 ans supplementing Law no 11/90 of 04 /21/1990 thé Algerian legislator approved a spesial holiday under the name of a holiday for the establishment of an institution what distinguishes it is tha it is an unpaid holiday ,that thé worker benefits once during his professional life,in order to create jobs and stimulate the spirit of economic entrepreneurship The work relationship is suspended during the holiday period for establishing an establishment ,this is what stipulated in article 03 of Law 16/22 which amended article 64 of Law 11/90 ,by inclouding it among the previous cases of suspending the work relationship. The worker also benefits from right during its period ,the most important of which is to celebrate his work position and return to it after its end. |
