| Résumé: | أصبح المجرمون في عصرنا هذا يعتمدون على الوســائل التقنية في ارتكـــاب جريمة الهجرة غير النظـــامية، وهذا ما يجعل اكتشافهم من قبل السلطات القضائية بناء على أساليب التحري التقليدية أمرا صعبا، من هنا أدرك المشرع ضرورة تفعيل نظام البحث والتحري عن هذا النمط الخطير من الإجرام العابر للحدود الوطنية، وذلك عبر تعزيز صلاحيات ضباط الشرطة القضائية وتمكينهم من استعمال أساليب تحري خاصة، قام باستحداثها بموجب القانون رقم 06- 22 المعدل والمتمم لقانون الإجراءات الجزائية؛ وتتمثل هذه الأساليب المستحدثة في المراقبة الإلكترونية والمراقبة الميدانية. من هنا تسعى هذه الدراسة لتحديد طبيعة الأساليب التي استحدثها المشرع بموجب هذا القانون لتفعيل عملية التحري عن هذه الجريمة وتحديد ضوابط إعمالها، حيث لم يجعل المشرع أمر اللجوء إليها مطلقا كونها تطعن في حقوق الأفراد وحرياتهم |
| Description: | Criminals have become dependent on technical means to commit the crime of irregular immigration, and this is what makes it difficult for them to be detected by judicial authorities based on traditional investigative methods, hence the need for lawmakers to activate the system of research and investigation of this dangerous transnational crime offense, strengthening the powers of the judicial police and allowing them to use special investigative techniques, which it had introduced in accordance with Law n° 06-22, amending and supplementing the law on criminal procedure, these new methods are represented in electronic monitoring and field monitoring. This study aims to determine the nature of the methods that the legislator has developed within the framework of this law to activate the process of investigating this crime and to determine the conditions for its implementation. |
