| Résumé: | نظّم المُشرّع الجزائري شروط الدخول أو الولوج إلى النشاط البنكي باعتباره نشاطاً اقتصادياً، وذلك بفرض نظام الرقابة عن طريق الترخيص والاعتماد؛ ويشمل الاعتماد كل التصرفات والتعديلات التي تقع على الغرض أو رأس المال أو المؤسّسين والأعضاء المسيّرين والمتصرفين في البنك؛ وتخضع الشركات المساهِمة التي تريد أن تمارس النشاط البنكي إلى مجموعة من الإجراءات: الترخيص، والقيد في السجل التجاري، والاعتماد، أخذاً ببعض خصائص تأطير المهنة المنظّمة، وقد يُفسّر التشديد في رقابة الدخول إلى النشاط الاقتصادي البنكي بضرورة ضمان الثقة والائتمان في المعاملات، وبصفة عامة حماية القطاع المصرفي الجزائري |
| Description: | The Algerian legislator regulates the conditions for access on banking activity as an economic activity, by imposing the system of control through authorization and agreement, and the agreement extends to all actions and adjustments occurring on the purpose or the capital or founders and members of the managers and disposers of the bank, so the joint stock companies that want to practice the banking activity are subject to a group of procedures: authorization, registration in the commercial register, and agreement, taking some of the characteristics of organizing an liberal profession, and a tightening of the entry control into the banking economic activity may explain the need to protect trust and credit in transactions and in general protect the Algerian banking sector. |
