| Résumé: | إن الالتزام الدولي باحترام حقوق الانسان واجب قانوني تتحمل به كل دولة اتجاه المجتمع الدولي، ويتضمن قيامها اتخاذ جميع الإجراءات اللازمة لكفالة احترام وتطبيق حقوق الانسان، وامتناعها عن كل ما هو من شأنه تعطيل هذا الهدف، ويكون للمجتمع الدولي سلطة اجبارها على ذلك، وعليه فإن احترام حقوق الانسان وحرياته الأساسية يعد التزاما قانونيا يستند إلى مصادر قانونية واضحة ومحددة ترتكز، كأصل عام، في الاتفاقيات الدولية العالمية والإقليمية المتعددة، وبناءً على ذلك فلسنا بصدد التزام أخلاقي أو طبيعي، وإنما بصدد التزام قانوني يترتب على تخلف الوفاء به من قبل الدولة قيام مسؤوليتها الدولية. |
| Description: | The international obligation to respect human rights is a legal obligation on the part of each State towards the international community and includes taking all necessary measures to ensure respect for and implementation of human rights and to refrain from anything that might impair this objective. The international community has the power to compel it to do so. Human rights and fundamental freedoms are a legal obligation based on clear and specific legal sources that are based, as a general principle, on the various international and regional international conventions. Consequently, we are not in a moral or natural obligation, but rather as a legal obligation resulting from under development by States International responsibility. |
