| Résumé: | من المعلوم أن الحقوق السياسية تعد من أهم الحقوق التي يمكن أن يتمتع بها أي إنسان داخل الدولة التي ينتمي إليها، فهي حقوق متعلقة برابطة الجنسية، لذلك تثبت للمواطن دون الأجنبي. فإذا كانت هذه القاعدة عامة، فإنه ينبغي أن نأخذ في الحسبان أن هناك بعض الدول التي تضم بين سكانها أقليات، وأفراد الأقلية يختلفون عن غالبية سكان الدولة إما بسبب الأصل أو اللون، أو اللغة أوالدين. وتجد الحقوق السياسية أساسا لها في عدد معتبر من الإعلانات والاتفاقيات الدولية ذات الصلة. وباعتبار أفراد الأقلية يحملون صفة المواطن، فمبدأ المساواة -الذي تنص عليه غالبية الدساتير مسايرة لقواعد القانون الدولي- يقتضي تمتع أفراد الأقلية بجميع الحقوق السياسية بما في ذلك حق تولي الوظائف العامة، وحق الترشح والانتخاب؛ غير أن الواقع العملي يبرز غير ذلك. لأجل ما سبق، تتناول هذه الورقة البحثية مدى تمتع الأقليات بالحقوق السياسية في ضوء قواعد القانون الدولي. |
| Description: | It is well known that political rights are among the most important rights that any person can enjoy within the state to which he belongs. If this rule is general, it should be borne in mind that some countries have minority populations and minority members differ from the majority of the population of the State either by origin, color, language or religion. Political rights are found to be their basis in a significant number of relevant international declarations and conventions. As members of the minority hold the status of citizen, the principle of equality - which is provided for by the majority of constitutions in conformity with the rules of international law - requires the enjoyment by all members of the minority of all political rights, including the right to hold public office and the right to be elected. For the above, this paper examines the extent to which minorities enjoy political rights in the light of the rules of international law. |
